In September I made two phone calls to the Port Orange Code Enforcement hotline and left recorded messages without receiving a follow up reply. I then sent, on Oct. 17, 2013 an email to as was directed to do when reporting a problem from the information found in the flyer that came with my water bill.
When I left the messages on the phone the recording stated that someone would contact me and the information in the flyer touting what the code administration department does also stated that someone would answer if I contacted this department.

I am still waiting  to hear from someone and the problem still exists. Please read on to learn about the problem that exist at 1233 Franklin Drive.

Subject: Stagnant Pool Water High Weeds & Grass
I have contacted Port Orange’s Code Enforcement Department on two occasions Monday 9/16/2013 at 9:16 HRS and on Tuesday 9/24/2013 at 17:07 HRS leaving detailed messages both times. I have not received a reply to my concerns related to the house next door located at 1233 Franklin Drive.
The house has been vacant  since December of 2011. The swimming pool water in the back yard has not been treated since the Summer of 2011 and during all of this time, a lawn service has trimmed the front lawn possibly 3 times at the most.  The front lawn has not been cut since June.

    Re: Case history for 1233 Franklin Dr.
    06/06/12 initial case opened for High Weeds and Grass. There was also a report of a green pool. Code Officer Joseph could see the grass but not the pool. It is behind a privacy fence and unobservable. Officer Joseph Sent a request to Compliance Connection to maintain the property. This property is now in foreclosure. Property is being mowed and case closed.
    08/30/12 New case for High Weeds and Grass and green pool. Again the pool is behind a privacy fence and cannot be viewed. Officer Joseph did call Mosquito Control to possibly treat the pool. Property is being mowed and case closed.
    (Property has been maintained by preservation company during these months)
    06/28/13 Property Owners file for Bankruptcy Chapter 7.
    08/16/13 Code Enforcement has a current active case on this property initiated by officer Joseph for High Weeds and grass.
    Compliance Connection has stopped mowing because the property owners have filed for bankruptcy. This was discovered when Officer Joseph was researching the property to take it to a special magistrate hearing.
    08/26/13 Mr. King called to complain and Officer Joseph returned the call but no answer. Mrs. King called and said “you can call back
    if you want.”
    10/24/13 City nuisance abatement vendor scheduled to cut the grass next week.
    10/25/13 Officer Joseph spoke with Mr. King on this date and advised him of the case status. He stated that he has been mowing
    the property but is tired of doing it. He thanked her and was appreciative of her efforts.
    The issue with the pool is that the officer cannot legally see it. Code Enforcement Officer are civilian officers not sworn and have no legal right to trespass on private property to gain evidence or knowledge of code violations. Unless the party that took the photographs had permission to be on the property he would have had to have trespassed on the property to gather this evidence. We can use the pictures if Mr. King would be willing to testify that he took the pictures at any hearing or subsequent trial.

    Tuff Turf Lawn Service came today and did a stellar job mowing through over six months of neglected overgrown vegetation.
