My 2 cents :   If the former owner at 619 Lemon Street rented boat storage space and paid taxes, he must have kept records of all that rental income as required by law.

 Freedom of Information request.

 Please follow up on this for me today.  Below I have copied and pasted my email on 1-3-14 to Chris Hutchinson for you.  You were copied on this on 1-3-14.  We have a copy of a complaint from 9-3-13 that was made by Dru Urquhart and her family on 9-1-13 ..she and her family were having a barbeque on Sunday 9-1-13. The complaint states that pictures were taken by Scott Allman and Chris Hutchison on 9-3-13.  Copy of that complaint attached. 

 Under the Freedom of Information Act,  I would like any/all pictures taken by Code Enforcement staff or any city staff from 619 Lemon Street or Jack Wiles surveyor, Kuhar Surveying, when the initial survey was done in April 2013. 
 
We also request any pictures taken by Upham Surveying on the most recent survey ordered by the city on the boundary dispute.   We are hoping that both surveyors will be at the meeting on Wednesday, January 8th with the city so that we may question them on how they arrived at their findings.  We believe that pictures taken by Kuhar Surveying will be especially helpful to our position about the forest what was behind our homes. 
 
 Kuhar’s survey describes the area behind our homes as “wooded”.    I believe Margaret Momberger may have taken pictures as well of 619 Lemon Street on her various visits there.  We request those pictures too.

 


Dear Chris:

Per our phone conversation we would like copies of all code enforcement activity involving 619, 621, 627 and 631 Lemon Street, 630 Ruth Street and Jack Wiles and/or Atlantic Marine Development.

Also per our phone conversation please include the photos taken by Scott Allman on 9-3-13 at 619 Lemon Street and any other photos related to the above code enforcement activity.

Dear Robin:

To my knowledge, we have yet to receive anything from you on the FOI request dated January 3rd, 2014 that would document any  commercial activity behind our homes on Ruth Street and Powers Avenue that has ever occurred at 619 Lemon Street.   If, as the city suggests such documentation exists, then you already have this data and it should be easy to put together and get to us immediately.

“We would like all records current or past that the City of Port Orange has relative to any business or commercial usage, licensing or taxing for 619 Lemon Street, Port Orange, Florida 32127”

We would request too that any photographs that document any commercial activity occurring at 619 Ruth Street at any time in the past be included in this FOI.

Could you respond specifically to this request in writing as to whether the city holds any documents/photographs related to any commercial activity for 619 Lemon Street for any period?  In your written response, please kindly carbon Greg Kisela, City Manager.

Dear Chris:

 
Under the FOI act I am requesting copies of this complaint and all photos associated with this complaint.  Complaint originated by me on 7-3-07.  Final capture date of 8-31-07 states there are photos on file possibly taken by Billy Wohlhuter.  We know that photos must have been taken by responding CE staff as well since that is policy.  We request those as well The complaint states that Billy Wohlhuter was required to get a permit after the fact on clearing and tree removal that occurred stating that the work had been done.  We are requesting copies of that permit as well.
 
Staff referenced in this complaint as it proceeded are Aaron, Dena Peterson, Margaret; am assuming that is Margaret Momberger and Penelope Cruz.

    Greg,
    Quick follow-up on the legal non-conforming use status of the property at 619 Lemon St.
    Has a final determination been made on whether or not Atlantic Marine can use the property as a non-conforming storage lot?
    If yes, who was the City Official who made that determination and when was it made.
    If no, who will be the City Oficial who makes that determination and when will it be made.
    In either case please send us the documentation used to support/deny such a use and the written record of the determination.
