Dear Mayor Green and Mr. Kisela:
This is a 2 parter for you.
Email from Jack Wiles to Tim Burman dated 12-11-13 enclosed that we find very distressing. We think many will find it disturbing. Or should. Quotes below and PDF attached.
And 2nd: where are the answers to questions we posed on Wednesday, January 8th, 2014 that could not be answered by either you Mr. Kisela, Wayne Clark or Tim Burman or anyone there from the city that night because Margaret Momberger was sick? We were promised answers. To date. Nothing from the city.
Regarding the email exchange below between Jack Wiles and Tim Burman which occurred on December 11, 2013:

“Do you think we should have individual meeting with council or planning member’s inadvance to ensure we are on the right track and discuss some of the push back we may expect from neighbors to get their feelings on this?”
Apparently Jack Wiles can ask that a private meeting between himself and members of the planning commission and city council occur in advance of these bodies sitting formally to decide on the Atlantic Marine Development project. And he assumes that it will happen. Are you still standing on your position that there is no special treatment here of Jack Wiles and Atlantic Marine? Please Mr. Mayor and Mr. City Manager do not continue to insult the intelligence of the residents of our neighborhood and the larger community of Port Orange. We have the email dump from this exchange thanks to the Freedom of Information Act. I am enclosing this as a PDF. It appears too that there may have been discussion about this project at the City Council meeting of 12-10-13 where we were not in attendance. I had specifically asked Tim Burman to not let us miss any council meetings where this issue would be addressed because we wanted to be heard. Tim assured me it was not on the agenda for 12-10-13 and that he would keep us advised of meetings where anything about Jack Wiles and the Atlantic Marine Development would be discussed. So if it was not discussed at that meeting, where was it discussed and with whom?

Hi Tim,
As for the survey information, yes I will get that to you Thursday or Friday. This of course is a separate matter from the MDA and needs to be resolved before the holidays. I am not interested in delaying this matter any longer and with the additional information that I will be bringing you this week it should be an easy to accomplish.
As for the MDA I understand the need to make sure everything is in order. My only question there is; if the first reading to council isn’t until the 23rd of February, can the second reading be on the date you mentioned last evening of March 4th?. This purchase/sale has to close by April 1st or my contract is dead. I have to conclude the bank financing after the second reading which would only give us 3 weeks and that will be pushing it. I suggest having the meeting next week to address SDRC comments that Kim and I will receive later this week. If we can’t get the second reading by March 4th with this cautionary pace, then we may be wasting everyone’s time. I can’t emphasize enough that my contract is out of extensions. Do you think we should have individual meeting with council or planning member’s inadvance to ensure we are on the right track and discuss some of the push back we may expect from neighbors to get their feelings on this? My fear is by delaying this we still have planning or council say come back with this or that and it prolongs our closing, then we are out of contract. I am just trying to make sure the dates are tight. Thanks.

    Mrs. Gardner: Community Development is answering the remaining questions you had today.
    My understanding of Port Orange’s rules is that an applicant can request to meet with individual members of the Planning Commission/City Council to discuss their project prior to it being heard in open session. Some Planning Commission and City Council members agree to meet and some do not. I also understand if they agree to meet they must disclose that they have met at the time the matter is being considered.
    I do not see the Atlantic Marine on the December 10th agenda. Did I miss something?

    Dianne please tell me where i can find a written copy of the rule saying they are not allowed ro meet. Do your own home work. The city is not your personal secretary it is not their job to get you information do it yourself go to city hall and request it.
