Thank you Manager Harden,
What you have made perfectly clear is that you have zero intention of holding appropriate City Administrators, OR the Mayor’s Crony Contractor friends to any standard recognizable in the private sector without firm direction from Council.
Let me make equally clear that while non-senseical explanations may work on Council initially – they do not work on me.
The simple facts regarding the mailed copy of the Health Inspection reports as you have confirmed is that
* they were correctly addressed to the City and its properly registered DBA, at a City owned golf facility that is open for business 364 days a year.
That would strongly suggest that someone at that City owned facility received the mail containing those inspections on at least 6 occasions.
What that person or persons did with that mail may or may not rise to Mail Theft or Receipt of Stolen mail.
Will you undertake to ask the person or persons who receives the mail at that City owned facility the logical question as to what they did with that mail,
OR WILL it be necessary to do a repeat of what was required to get you to finally take the action you did on the missing berm ??.

Perhaps I did not make myself clear in my previous response. The mailed copies of the inspection reports were mailed to Cypress Head Golf Club, Inc at 6231 Palm Vista Street. So far as I can determine no one on City staff has ever received these reports.

If I have understood you correctly you have confirmed
*that the food service license was properly issued the City and to a DBA name that the City has registered with the State of Florida,
*and that a City owned property that is open for business 364 days a year was listed as the address on that license.
AS SUCH I AM NOT UNDERSTANDING HOW YOU CAN CONTEND THAT THE CITY HAS NOT BEEN RECEIVING the copy of the Dept. of Health inspections that were mailed to the licensee ……ON NO LESS THAN A 1/2 DOZEN OCCASSIONS OVER THE PAST 2 YEARS.
It is your job to find out what happened to the mail that contained those inspections, AND I would remind you that theft or receipt of stolen mail is a serious matter.
Indeed US Code Title 18 Part 1 € 1708 has the following to say about such activity.

Whoever steals, takes, or abstracts, or by fraud or deception obtains, or attempts so to obtain, from or out of any mail, post office, or station thereof, letter box, mail receptacle, or any mail route or other authorized depository for mail matter, or from a letter or mail carrier, any letter, postal card, package, bag, or mail, or abstracts or removes from any such letter, package, bag, or mail, any article or thing contained therein, or secretes, embezzles, or destroys any such letter, postal card, package, bag, or mail, or any article or thing contained therein; or
Whoever steals, takes, or abstracts, or by fraud or deception obtains any letter, postal card, package, bag, or mail, or any article or thing contained therein which has been left for collection upon or adjacent to a collection box or other authorized depository of mail matter; or
Whoever buys, receives, or conceals, or unlawfully has in his possession, any letter, postal card, package, bag, or mail, or any article or thing contained therein, which has been so stolen, taken, embezzled, or abstracted, as herein described, knowing the same to have been stolen, taken, embezzled, or abstracted—
Shall be fined under this title or imprisoned not more than five years, or both.

If you are able I would encourage you to resolve this matter yourself tomorrow and ensure all offending parties are no longer employed by the City, OR otherwise request the US Postal service to involve itself in this investigation.

According to state records the licensee is City of Port Orange (Primary Name) Cypress Head Golf Club Inc (DBA Name). Cypress head Golf Club Inc is a dissolved corporation. The address is 6231 Palm Vista St, which is the address of the Cypress Head Golf Clubhouse. It appears that this license should have been put into the City’s name with the City Hall address at least seven or eight years ago, but that was not done. As a result the City has not been receiving these inspection reports.

The City of Port Orange has frequently played fast and loose with explanations it gives its citizens.
In this instance the City may have out-foxed itself with its bogus “liquor license / food service ” explanation corporations.
My question to you is as follows.
Who has been receiving the copy of the Dept. of Health inspections that are mailed to the licensee, which is to say the City all be it through its DBA ” food service ” corporation ??
AND if it is your contention that those inspections have not been received by the City will you inquire as to whether the City’s mail been tampered with ??
