DEBARY – The city plans to settle two lawsuits involving public records, but the issue remains contentious for the City Council.
Former City Councilman Norm Erickson and former City Clerk Stacy Tebo had filed two separate lawsuits and the City Council decided Wednesday night to settle both cases. Mayor Clint Johnson voted against both settlements.
Later in the meeting, the council unanimously voted to have the city attorney and city manager look into current public record requests involving Johnson after a heated debate between Johnson and Councilman Rick Dwyer.
As part of the approved settlements, Erickson and Tebo will both be awarded $10,000.
“It’s just to get the records, it’s not to get money,” Erickson said, noting the money is for attorney fees.
Tebo’s lawsuit argued the city delayed its response to her public records request until it began charging money for the records in a “thinly veiled attempt to shield itself” from her request. The lawsuit also alleges the city erred in releasing an Equal Employment Opportunity Commission complaint against City Manager Dan Parrott to a Daytona Beach News-Journal reporter.
The second lawsuit, from Erickson, deals with Mayor Clint Johnson’s Mayor’s Mailbox and surveys returned to the box placed in the DeBary Commons shopping center.     …..
