    It was with real distress that I watched Ted Noftall being treated with palpable contempt by the newly installed Port Orange mayor, Don Burnette, in this video posted by Mike Gardner where Ted is shown speaking to council on Tuesday, December 6, 2016.

    Ironically, Ted was speaking to his concerns about Port Orange’s civility statement, its constitutionality with regard to the First Amendment, its true intent as a document governing behavior and language from the podium by citizens, and implications for intimidation of residents coming before council.

    Mr. Burnette’s discourteous manner and obvious displeasure that Ted was before him were painfully clear in his actions: reading and rustling papers, making no eye contact with Ted, reading his tablet, and exhibiting a facial expression of annoyance while Ted was speaking.

    So, I would ask Mr. Burnette what is civility? A few examples: Formal politeness in behavior or speech; good manners, graciousness, comity, respect, and finally in your role as mayor, paying attention to a member of the electorate who stands before you expecting to be heard. Looked to me like “civility” is a one way street for Don Burnette. I was very conscious that Chase Tramont and Drew Bastian were the only members of council paying attention to Ted.

    I would remind Don Burnette that Ted Noftall is not some marginal political gadfly up there at the podium just trying to be annoying.

    Ted has attended virtually every city council meeting for years, coming prepared with serious questions and a good understanding of topics on the agenda. Ted gave dedicated service as the elected chairman on the Audit and Budget Board before he was so discourteously dismissed by Don Burnette for posing too many awkward questions about city finances to the City Manager and the Finance Director.

    Ted was a serious mayoral candidate who came in 2nd in the primary on August 30th out of a field of 3, one of whom was Mayor Allen Green’s son and Ted received 11,700 votes on November 8th. Ted had and has a significant following among voters and people are paying attention to how the new mayor will treat those who differ with him on various topics.

    As a taxpayer, citizen and dedicated observer of city government, Ted Noftall has a right to be heard, heard with respect and yes, civility.

    Mike, it’s not that Ted forces people to think, it that he bullies and makes people uncomfortable. He wants to rule with an iron fist, he wants this city run his way or no way. He has no middle ground. Oh and lots of people on this site left him high and dry when he wanted to bring warren pike back, but I guess you all forgave him for that. I hate politics, I just want a good person for mayor.

    I saw on a previous post teddy called people chicken shit for not posting there names. Is teddy mad that some people make good points and don’t post their names?? Still have not read anything on how he will make the city better yet, just how he likes to bully people. I will be so happy when the election is over. I hope whom ever wins the election will try and make the city better. To be honest, this is one of the best cities on the planet in my opinion. Will take a whole lot to make it better. We live in a great city!!!!

      Ted consistently defended the use of pseudonyms back when Hank’s was the only blog site and he would not publish comments written anonymously. Ted did so because he knows good points are worth hearing no matter who makes them.

      But comments like ” is teddy mad ” or ” he likes to bully people ” are not good points Mr. Concerned.

      They are nothing more than ad hominem attacks written by a partisan coward afraid to sign his name to anything. who then tries to wrap himself up in the flag of this is a great city.

      Ted has consistently said Port Orange is a great city. What he has said is not so great is its government. But with your ties to city government you sure do not want to heat that now do you Mr Concerned.

His posts serve to protect his own self-interests and indicate a willingness to be led by others without any independent thought on his part.     Concerned citizen–Maybe you heard something I missed at the Council meeting where they voted to hire outside legal advice. No one said anything about investigating Burnette’s misuse of the City seal. The facts seem pretty cut and dried–Burnette violated both Port Orange and State law. It also seems equally cut and dried what the Council wants to do about it–not a thing.

    The only reason they hired an outside lawyer is to see whether, by their failure to enforce the law, they have left themselves open to any legal consequences. If outside counsel tells them not to worry about it, we’ll never hear about misuse of the seal again.

    If I understand you correctly: when Burnette breaks the law and the rest of Council sweeps it under the rug you think Ted should pay for a lawyer to tell them it’s all OK because he pointed out the problem in the first place!?

    The Councilmen minus the Mayor go out drinking together. I have seen them. I believe it was back in December at the Brewery. The second time I saw them was minus the young one that sits to the far left. It was just the other three. None of them could penalize one another. I think they got each others backs. They seem to all be friends. I can see why they wasted that money to hire someone to make a decision for them because they don’t have the nerve to make the decision themselves. Oh well. Cheers!

    CC Noftall is just a citizen that pointed out a crime that was committed and Don Burnette has a long history of this kind of lawlessness. Just go to the Volusia County Clerks office to see for yourself. He has the attitude of ask for forgiveness instead of asking for permission. If Ted were Mayor, I don’t believe he would have wasted that up to $5000. He would have governed and handled the situation regardless of who had done it.

        I think the real issue is as taxpayers and American citizens do we have any respect for the integrity of the political process? Clearly, as a long time councilman and a previous vice mayor, Don Burnett knows that it is a misdemeanor carrying a penalty of either a $500.00 fine or 6 months in jail for using the city seal in one’s personal political campaign.

        Don Burnett claims he did this inadvertently, but if you check around you will find that he previous to this infraction took out a large political add in a coupon book with a picture of himself prominently displayIng the city logo seal on his lapel.

        It is a no brainier that Burnett did this intentionally and should at the very least be responsible for that $500.00 fine if not doing 6 months in the pokey.

        tHe problem though is that the political boost that Burnett will obtain from his illegal action far exceeds a $500.00 fine. Uninformed voters that do not know Don Burnett or Ted Noftall from a hole in the ground will be influenced by the implied message that the City of Port Orange endorses Don Burnett as its preferred political candidate thereby influencing uninformed voters to vote for him.

        If the city council and the City of Port Orange have one iota of integrity and any respect for the integrity of the political process, they need to send out an immediate mail out to all of their utility customers stating that Don Burnetts utilization of the city seal for his political campaign is a misdemeanor, and that the City of Port Orange does not endorse any particular candidate. The city should also take out an ad in the News Journal to this effect and ask the local news to televise that information.

        By doing all this, any unfair reward or bump that Burnett might receive from his illegal action will be neutralized by getting the truth out. This is the only fair thing to do for the voters and the political process. If the city council is not corrupt, than it is obvious that they have a fiduciary responsibility to ensure the truth gets out to their constituency.

    Apparently they feel there is some question or ambiguity regarding the use of the city seal. That or they are afraid to make a ruling on how it was utilized. Thus now we have an outside attorney involved to make a ruling so nobody within the city has blood on their hands.

    So Mr Noftall, should this outside attorney rule that the seal was not misused and the ruling is not in your favor, will you reimburse the legal fees to the city ? If they rule it was used improperly, will Councilman Burnette man up and reimburse the absurd legal fees ? Why did Burnette not abstain from voting in favor of hiring this outside attorney ?

    I guess some people on this sight call people names and belittle people to make them selves feel better. It seems that’s the route to go for a select few here. I am glad you informed us all about the ordinance. I also would like what Mr Noftal is going to do if elected. I have heard nothing but make everything transparent not anything else. Will he bring back warren pike like he suggested before on this blog? What will he do?? As far as who I am, I am a citizen of this city. Hope that satisfies your curiosity. I do think the name calling is a type of bullying to try and get people not to post on here, or to make them afraid to post their opinions. I did if you notice say if in my last post if i my interpretation is wrong I apologize. Of course that led to name calling from some one on here.

      I often times have great difficulty understanding the sensibilities of those of you who use pseudonyms for all of your communications.

      To be clear Council did not hire Attorney John Connor to get an opinion on anything not with-standing the Assistant City Attorney’s obfuscation regarding ” public record matters and complex public records issues ” Florida’s open government laws are amazingly simple to follow — absent an exemption in Statute requested public records must be produced.

      Mr Connor’s own website advises that he specializes in the defense of municipalities. In Mayor Green’s own words ” We have to be able to protect ourselves ”

      Port Orange government knows that in failing to enforce their own Ordinance against one of their own they screwed-up and now they have ” Lawyered-up ”

      Port Orange government encores a multitude of ordinances against ordinary residents every day of the week often at great personal expense to those residents

      BUT rather than enforce the “seal ordinance ” they passed they would rather spend taxpayer money ” protecting ” themselves from not following their own law.

      Two further issues
      1) While one councilman bemoaned – what a waste to spend money ($5,000) on that stupid stuff. NO comment what-so-ever was made by any member of Council regarding the near $ 400,000 expenditure Council approved on consent in that same meeting — to survey City ditches.
      .
      2) As both of these matters ( Lawyering-up & Ditch surveying ) were approved without public comment by Council they were likely worked out in yet more private meetings.

    How ridiculous, unprofessional and completely disgusting to resort to name calling. Everyone is entitled to their opinion and should not be subject to ridicule and name calling just because you happen to disagree.

    If their is opinion is based on factually incorrect information then correcting that inaccuracy is fine but ridicule and name calling should never be tolerated.

    Having factually inaccurate information may make one misinformed but it does not make one stupid, incompetent or foolish. Resorting to name calling and ridicule is however foolish at best and downright bullying at worst. Unfortunately this is not surprising given the source of these types of comments.

      Awww…………”Doofus” is a pejorative term that in my mind conjures up a vision of a Jethro Bodine type of guy without Jethro’s genial nature. “Stupid” is simply slow witted, as in someone who attacks Mr Noftall’s email without referencing anything in it. “Incompetent” is not being equal to the task at hand, as in someone incapable of reading, understanding, and commenting on Noftall’s three questions. “Foolish” generally means lacking in good sense, as in someone who realizes they have factually incorrect information AFTER they shoot their mouth off.

    You doofuses should start by reading Section 2-3 of Port Orange’s very own Code of Ordinances. It can be found at:

    In it you will find the City’s (not the State’s) regulations concerning the use of the municipal seal. If you read further on in that same Code you will find who is responsible for enforcing the City codes and ordinances. I’ll give you a little hint–it is NOT the State Attorney.
    Guzzi–What are you talking about? What is Mr Noftall doing? Talk about cheap–all you are is talk.

    To truth be told, I think your advice applies to mr Noftal as well, he should take legal actions against anyone he thinks is breaking the law. You do see how that applies to mr noftals situation also, and telling everyone or one person they don’t know jack is your way of saying he might be squirrelly but prove it. Name calling and bullying is never the answer. I think calm conversations and looking at all the facts is the best way to deal with problems.

      Name calling, bullying, arrogance and a condescending attitude etc. is the modus operandi for Mr. Noftall and his Lieutenants – the Gardners. See other post where the articulate Mr Gardner refers to some as “doofus” .

      It somewhat of a shame as Mr. Noftall is indeed intelligent, and a knowledgable person with a terrible approach and demeanor. Somewhat Trump esque. This will be the main reason he will likely not be successful in his political bid. At times, he purports to have the citizen’s best interests in mind. Other times, he seems to have his own agenda with little regard or room to debate.

Your asking him questions as if to say he should investigate the issue, when he is the person working for council. Did you send the email to him so you could try to make him look bad?     Let them make the decision to pursue or drop it.

    I don’t know why this Is news, Mr. Noftall used the city logo on one of his mailers in the past, then when he was called out on it he used the tree part of the logo, removing the city’s name.     This is “leadership” that makes a difference? Don reminds us constantly that he has 6 years on council. Those 6 years were some pretty bad years for the City of Port Orange in terms of revelations. Happened on your watch, Don. Don Burnette’s leadership qualities and experience are his rationale for election for Port Orange mayor. Much like Hillary Clinton’s vast “experience” in government qualifies her to be president? What about those pesky emails and what FBI Director James Comey called carelessness in their handling? Hillary Clinton too wants to minimize her “goof”.

    This is a little more than a “goof” Don. See Don’s quote below from News Journal article: “I overlooked it. It was my goof. I take responsibility for that,” Burnette said, adding it was one of several items his campaign asked the printer to remove but he never followed up on it.”

    “Never followed up on it”? Why did you not acknowledge the “goof” as soon as you became aware that it had occurred? How does one demonstrate “honesty and integrity”? How can the electorate determine whether a person has those qualities or not? Aren’t those quality made manifest in our behavior? Claims to competence, leadership, honesty and integrity are words associated with your campaign; how are those displayed in this unforced error?

    Looks like you just hoped it would go unnoticed while benefiting from the use of the city’s logo. You knew full well that the Port Orange city logo gives an imprimatur to your mailer. It looks “official”; like a city sponsored document.

    Common decency with a strong inclination toward personal honesty who will acknowledge a mistake before we have to beat it out of them is what I am seeking in a mayor and a president for that matter. And yes, that person needs to have attention to detail.

    We lurch from one stupid mistake to the next: nationally and locally. It looks like Don Burnette will continue that distressing tradition. If you cannot manage your own mailer how can you manage the job of mayor, Don?

    And yes, C Dundee, the other elites on council apparently are just going to laugh this one off too. No one up there on the dais is ever willing to criticize another sitting councilman; their allegiance is to each other. Not to the taxpayer or the electorate. There is never a sanction or consequence. Mistakes happen, in all departments, but we have to “move on”, “look forward”, never look back. God forbid, we ever appear to be “negative”. As Don says “hindsight is 20/20”. Yes Don, but we never seem to learn from our mistakes.

    Trump and Sanders are right: the system is rigged.

      Your friends are misinformed. A lot of people won’t identify themselves for fear of retaliation. Woody no longer works at the city so he has no worries, he can put all his misinformation out there and some of you think it’s gospel. Well it’s not, he has some bad sources and needs to find some that know what they are talking about and have some actual knowledge.

    The system ran for a while. Then the line floated. Efforts have been made to anchor the line. I hope it gets properly repaired. Name calling and trying to deflect from the problem won’t change anything. If the line keeps floating someone will have to go to council and explain why we need to throw more money at the project. That’s one good reason why this stuff should be immediately reported. Look at the history of this project from the beginning. All of the problems encountered and money thrown at it trying to get it right.
